WHAT IS AN EXPERT WITNESS?

An expert witness is someone who gives an independent opinion on the facts of the case. They are entitled to give that opinion because of their qualifications and experience. They cannot express or give an opinion without having a foundation of fact.

Expert witnesses may be asked to write a report or called to give evidence in virtually every legal forum: civil and criminal courts, tribunals, arbitration and mediation.
